Below, we provide information on the collection of personal data when you use our website and contact us. Personal data refers to any data that can be linked to you personally, e. g. name, address, email addresses and user behaviour.

2 Collection and processing of personal data when contacting us

2.1 Contact via email, contact form or telephone

You can also contact us via the email address provided, a contact form or the telephone number provided. In this case, the personal data you provide (such as your name, email address or telephone number) will be collected and processed in order to deal with your enquiry. All the information you provide is voluntary. However, the data we request is necessary to process your enquiry. If you do not wish to provide us with certain data, we will therefore be unable to process your enquiry. We also use WhatsApp for further communication with you. By providing us with your telephone number, you agree that we may continue to contact you via this channel in future, even if no treatment has taken place as a result of your cancellation.
Please note that, for medical reasons, we only treat adults. We therefore do not accept enquiries from minors.

EuroEyes Deutschland Holding GmbH & Co. KG itself does not provide any medical services to patients. When you contact us, we merely provide general information in response to your enquiry and, where appropriate, arrange an appointment for a consultation, examination and/or treatment at one of our subsidiaries. We therefore pass on your personal data to these companies so that you can book an appointment there to receive further information. As a rule, this is the company you have specified as your preferred location or the one closest to your address.

In particular, we share an appointment management system with the companies listed above. Therefore, when you book an appointment with us, these companies will have access to your personal data.

Please note that these companies will provide you with their own privacy policies as part of further communication.

As soon as your data is no longer required for the purpose for which it was processed by us, it will be deleted; alternatively, we will restrict its processing if statutory retention obligations apply.

The legal basis for the processing of personal data, other than health data, which is transmitted when sending an email, submitting an enquiry via the contact form or making a telephone enquiry, is Article 6(1)(f) f of the GDPR. If the email contact, use of the contact form or telephone enquiry is aimed at concluding a contract, the additional legal basis for processing is Article 6(1)(b) of the GDPR.

If you provide us with health data as part of your communication with us, this is also voluntary. By providing this information, you give us your consent to process the data for the purpose described above. The legal basis for the processing of health data on the basis of your consent is Article 9(2)(a) of the GDPR.

We expressly point out that you may withdraw your consent at any time. Withdrawal does not affect the lawfulness of processing carried out on the basis of your consent up to the point of withdrawal.

Where your consent is required for further processing, we or our subsidiaries will seek it.

2.2 Extended email correspondence

(1) To ensure the prompt and efficient handling of enquiries and event registrations, EuroEyes may automate email correspondence. This is carried out via the German provider CleverReach. The personal data required for this purpose (email address, name where applicable, IP address, date and time of registration) is transmitted to CleverReach, where it is temporarily stored and processed.

(2) Interested parties can unsubscribe from automated correspondence with a single click within any automated email, thereby preventing the processing of their data. Furthermore, personal data will be blocked and deleted as soon as the immediate purpose of the contact enquiry has been fulfilled.

(3) A data processing agreement in accordance with the GDPR has been concluded with CleverReach GmbH &
Co. KG, a data processing agreement has been concluded in accordance with the GDPR, in which CleverReach guarantees compliance with European data protection law. Further information on data protection at CleverReach GmbH & Co. KG can be found at: https://www.cleverreach.com/de/datenschutz/

2.3 Contact via WhatsApp

WhatsApp is a service provided by WhatsApp Inc., which in turn is part of Facebook, Inc. EuroEyes uses this external application solely as a communication channel. EuroEyes is in no way responsible for the content and data that you voluntarily send to us via WhatsApp.
When you send us a message via WhatsApp, you are thereby providing us with your telephone number and, in some cases, your real name. We use the number and your name solely for WhatsApp communication with you, and the chat content solely to process your enquiry.

Please note, however, that WhatsApp’s Terms of Service, over which we have no control, apply: by installing and using WhatsApp on your mobile phone, you agree to WhatsApp’s Terms of Service. These include, amongst other things, granting WhatsApp Inc. access to your telephone number and the contacts stored on your phone. For enquiries of a personal or confidential nature (i.e. those involving personal data or health data), you should provide an email address or telephone number for further correspondence, as we do not answer such enquiries via WhatsApp.

EuroEyes will under no circumstances ask you to share personal data or health data with us via WhatsApp. Should we require your data, a member of staff will inform you of a secure method for exchanging data, such as a secure online chat.
Should you have any further questions regarding data protection at EuroEyes, you may contact our Data Protection Officer at any time. You will find the contact details for the Data Protection Officer under point 1 of this privacy policy.

3. “Online Eligibility Test”

When you complete the “Online Suitability Test” on our website, the answers you select are transmitted to our server. The test is conducted anonymously; however, your IP address – which also constitutes personal data – is visible. Your consent is therefore required for the transmission of this data. This consent is voluntary. If you do not give your consent before submitting your data, the test will not be carried out.

The data transmitted is not stored; it is deleted immediately after the test has been completed. It is used solely to suggest a treatment method that may, in principle, be suitable for correcting your vision problems.

The legal basis for the processing of health data on the basis of your consent is Article 9(2)(a) of the GDPR.

We expressly point out that you may withdraw your consent at any time. Withdrawal does not affect the lawfulness of processing carried out on the basis of your consent up until the time of withdrawal.

4. Collection and processing of personal data when visiting our website

Where we use contracted service providers for individual functions of our website or wish to use your data for marketing purposes, we will provide detailed information on the respective processes below, and in the following sections, in detail about the respective processes. In doing so, we will also specify the criteria for the retention period.

When you use the website purely for information purposes, we only collect the personal data that your browser transmits to our server. We collect the following data, which is technically necessary for us to display our website to you and to ensure its stability and security (the legal basis is Article 6(1), first sentence, point (f) of the GDPR):

5. Use of cookies

In addition to the data mentioned above, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your hard drive and associated with the browser you are using, and through which certain information is transmitted to the entity that sets the cookie (in this case, us) can receive certain information. Cookies cannot run programmes or transfer viruses to your computer. They serve to make the website more user-friendly and effective overall.

b) Transient cookies are automatically deleted when you close your browser. These include, in particular, session cookies. 6. Web analytics, monitoring and optimisation

Web analytics (also referred to as ‘reach measurement’) is used to analyse visitor traffic to our online service and may include pseudonymous data relating to visitors’ behaviour, interests or demographic information, such as age or gender. With the help of reach measurement, we can, for example, identify at what times our online service, its functions or content are used most frequently, or encourage repeat visits. We can also identify which areas require optimisation.
In addition to web analytics, we may also use testing methods to, for example, test and optimise different versions of our online service or its components.
Unless otherwise stated below, profiles – i.e. data aggregated for a specific usage session – may be created for these purposes, and information may be stored in a browser or on a device and retrieved from it. The data collected includes, in particular, the web pages visited and the elements used there, as well as technical details such as the browser and computer system used, and information on usage times. Where users have given their consent to the collection of their location data, either to us or to the providers of the services we use, location data may also be processed.
Users’ IP addresses are also stored. However, we use an IP masking procedure (i.e. pseudonymisation by truncating the IP address) to protect users. Generally, no plaintext user data (such as email addresses or names) is stored in the context of web analytics, A/B testing and optimisation; instead, pseudonyms are used. This means that neither we nor the providers of the software used know the actual identity of the users, but only the information stored in their profiles for the purposes of the respective processes.

  • Types of data processed: usage data (e.g. webpages visited, interest in content, access times); meta, communication and process data (e.g. IP addresses, time stamps, identification numbers, consent status).
  • Data subjects: users (e.g. website visitors, users of online services).
  • Purposes of processing: Audience measurement (e.g. access statistics, identification of returning visitors); profiles containing user-related information (creation of user profiles).
  • Security measures: IP masking (pseudonymisation of the IP address).
  • Legal basis: Consent (Article 6(1), first sentence, point (a) of the GDPR).

7. Use of Google Analytics

(1) This website uses Google Analytics, a web analytics service provided by Google Inc. (“Google”), to analyse the use of the site. The statistics obtained enable us to improve our service and make it more interesting for you as a user. Google Analytics uses so-called ‘cookies’, text files that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie regarding your use of this website is usually transmitted to a Google server in the USA and stored there. However, if IP anonymisation is enabled on this website, your IP address will first be truncated by Google within Member States of the European Union or in other signatory states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide the website operator with further services relating to website and internet usage.

(2) The IP address transmitted by your browser as part of Google Analytics will not be merged with other data held by Google.

(3) You can prevent the storage of cookies by adjusting your browser settings accordingly; however, we would like to point out that, in this case, you may not be able to make full use of all the functions of this website. (4) This website uses Google Analytics with the “_anonymizeIp()” extension. This ensures that IP addresses are processed in a truncated form, thereby ruling out any possibility of personal identification. Where the data collected about you is personally identifiable, such identification is therefore immediately ruled out and the personal data is deleted without delay.

(5) In the exceptional cases where personal data is transferred to the USA, Google has opted into the EU-US Privacy Shield, https://www.privacyshield.gov/EU-US-Framework. The legal basis for the use of Google Analytics is Article 6(1)(f) of the GDPR.

8. Further information on processing operations, procedures and services:
Google Signals (Google Analytics feature): Google Signals consists of session data from websites and apps that Google associates with users who are signed in to their Google accounts and have enabled ad personalisation. This association of data with these signed-in users is used to enable cross-device reporting, cross-device remarketing and cross-device conversion measurement. 9. Embedding of YouTube videos

(1) We have embedded YouTube videos into our online service which are stored on http://www.YouTube.com and can be played directly from our website. These are all embedded in ‘enhanced privacy mode’, i.e. no data about you as a user is transferred to YouTube unless you play the videos. Only when you play the videos is the data referred to in paragraph 2 transmitted. We have no control over this data transmission.

(2) When you visit the website, YouTube receives the information that you have accessed the relevant subpage of our website. In addition, the data described in paragraph 3 is transmitted. This occurs regardless of whether you are logged in to a YouTube user account, or whether you do not have a user account. If you are logged in to Google, your data will be directly associated with your account. If you do not wish your data to be associated with your YouTube profile, you must log out before activating the button. YouTube stores your data as user profiles and uses them for the purposes of advertising, market research and/or tailoring its website to users’ needs. Such analysis is carried out in particular (even for users who are not logged in) to deliver personalised advertising and to inform other users of the social network about your activities on our website. You have the right to object to the creation of these user profiles; to exercise this right, you must contact YouTube.

10. Integration of Google Maps

(1) On this website, we use the Google Maps service. This enables us to display interactive maps directly on the website and allows you to use the map function conveniently.

(2) When you visit the website, Google receives the information that you have accessed the relevant page of our website. In addition, the data described in paragraph 3 is transmitted. This occurs regardless of whether you are logged in via a Google user account or do not have a user account. If you are logged in to Google, your data will be directly associated with your account. If you do not wish your data to be associated with your Google profile, you must log out before clicking the button. Google stores your data as usage profiles and uses them for the purposes of advertising, market research and/or to tailor its website to users’ needs. Such analysis is carried out in particular (even for users who are not logged in) to provide targeted advertising and to inform other users of the social network about your activities on our website. 11. Use of Google AdSense

(1) This website uses the online advertising service Google AdSense, which enables us to display adverts tailored to your interests. Our aim is to show you adverts that may be of interest to you, in order to make our website more engaging for you. To this end, statistical information about you is collected and processed by our advertising partners. These advertisements can be identified by the label ‘Google Ads’ on the respective advert.

(2) When you visit our website, Google receives information that you have accessed our website. To this end, Google uses a web beacon to set a cookie on your computer. Data is transmitted; you can find out the content of this data from the information provided in paragraph 4. We have no influence over the data collected, nor are we aware of the full scope of the data collection or the duration of storage. Your data is transferred to the USA and analysed there. If you are logged in to your Google account, your data can be directly associated with it. If you do not wish your data to be associated with your Google profile, you must log out. It is possible that this data may be passed on to Google’s contractual partners, third parties and public authorities. The legal basis for the processing of your data is Article 6(1)(f) of the GDPR. This website does not display third-party adverts via Google AdSense.

12. Use of Google Remarketing

We use the Google Remarketing service. This is a method we use to target you again. Through this service, our adverts may be displayed to you whilst you are browsing the internet after visiting our website. This is achieved by means of cookies stored in your browser, which Google uses to record and analyse your browsing behaviour when you visit various websites. This enables Google to identify your previous visit to our website. According to Google’s own statements, the data collected as part of remarketing is not combined with your personal data, which may be stored by Google. In particular, Google states that pseudonymisation is used for remarketing.

13. Use of Facebook Retargeting

(1) Furthermore, the website uses the ‘Custom Audiences’ remarketing function provided by Facebook Inc. (‘Facebook’). This enables interest-based advertisements (‘Facebook Ads’) to be displayed to users of the website whilst they are visiting the social network Facebook or other websites that also use this method. Our aim is to show you adverts that are of interest to you, in order to make our website more appealing to you.

(2) Due to the marketing tools used, your browser automatically establishes a direct connection to Facebook’s server. We have no influence over the scope and further use of the data collected by Facebook through the use of this tool and therefore inform you in accordance with our current knowledge: Through the integration of Facebook Custom Audiences, Facebook receives the information that you have visited the relevant page on our website, or that you have clicked on one of our adverts. If you are registered with a Facebook service, Facebook may associate your visit with your account. Even if you are not registered with Facebook or are not logged in, it is possible that the provider may obtain and store your IP address and other identifying characteristics.

14. Use of Twitter retargeting

These pages use Twitter’s “Tailored Audiences” remarketing feature (Twitter Inc., 1355 Market Street Suite 900, San Francisco, CA 94103, USA). This feature enables us to target website visitors with advertising by displaying personalised, interest-based adverts when you visit Twitter. Twitter uses so-called tags to analyse website usage, which forms the basis for the creation of these interest-based adverts. These tags are used to record visits to the website and data relating to its usage.
When a user visits a website containing a tag, Twitter places a cookie in the user’s browser. The unique ID of this cookie is recorded and the user is included in the remarketing audience on Twitter. If you subsequently visit Twitter, you will be shown adverts that are highly likely to reflect the product and information sections you have previously viewed.

If you do not wish Twitter to target you with personalised adverts, you can disable this feature on Twitter. You can find information on this here. Twitter also supports the ‘Do Not Track (DNT)’ option. If you have enabled the DNT option in your browser, Twitter will not link your account to browser-related information in order to display personalised adverts to you. The legal basis for the processing of your data is Article 6(1)(f) of the GDPR.

15. Use of LinkedIn Retargeting

(1) On our website, we use the analytics and conversion tracking technology provided by the LinkedIn platform (LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA). When using LinkedIn domains and when LinkedIn users visit our website, these remarketing tags establish connections between the user’s browser and the LinkedIn server. In the process, aggregated, anonymised data is also transmitted to LinkedIn.

(2) We receive anonymised reports from LinkedIn on advertising activities and information about how you interact with our website. Please note that, as the provider of the website, we have no knowledge of the content of the data transmitted or how it is used by LinkedIn.

16. Use of AdRoll retargeting

This site uses AdRoll retargeting technology (AdRoll, 972 Mission St, 3rd Floor, San Francisco, CA 94103, USA). This enables us to target visitors to our websites with interest-based advertising by means of a cookie-based analysis of previous user behaviour. No personal data is stored in the process. 17. Use of Adform Retargeting

We use so-called ad server systems to carry out online advertising campaigns and, consequently, to deliver adverts on desktop computers and mobile devices.

These systems control the delivery of adverts using cookies. The cookies are stored on your computer or mobile device when you are exposed to our adverts, when you click on them, or when you visit our website. The ad server systems and cookies enable us to measure the success of our advertising campaigns and to target visitors to our website with personalised, interest-based adverts. No personal data is stored.

If you do not agree to this, you can disable the use of cookies by the ad server systems via a cookie opt-out below.
Adform opt-out (site.adform.com)

Setting the opt-out does not prevent us from continuing to show you adverts. These will simply no longer be tailored to your use of our website and our services. In some circumstances, this may even result in you seeing significantly more adverts, as it is no longer possible to recognise how often adverts have already been displayed on your device.

18. Use of Google AdWords Conversion

(1) We use the Google AdWords service to draw attention to our attractive offers on external websites by means of advertising (known as Google AdWords). We can use the data from the advertising campaigns to determine how successful the individual advertising measures are. In doing so, we aim to show you adverts that are of interest to you, make our website more appealing to you and ensure a fair calculation of advertising costs.

(2) These adverts are delivered by Google via so-called ‘ad servers’. To this end, we use ad server cookies, which enable us to measure certain performance metrics, such as the display of adverts or clicks by users.
